I will bring a copy of this waiver release form to be signed  before the workshop.

Waiver Release and Assumption of Risk Outer Banks Photo Workshops

Throughout this document, any combination of Outer Banks Photo Workshops, Dan Waters Photography, Daniel Waters, shall be referred to as “Releasees.”

I am aware that are inherent dangers in participating in this photo workshop or private instruction with the Releasees, including, but not limited, to driving, hiking, photographing outdoors, accident or illness. I understand that workshops or private photography instruction involve risks and dangers of serious bodily injury, as well as risks and dangers to my photography equipment. My personal safety cannot be guaranteed. I certify that I am in reasonably good physical condition and health to participate in this photo workshop or private photography instruction.

I understand that my photography equipment and/or personal belongings could be damaged during the workshop or private instruction by a number of factors that include, but not limited to, natural forces such as rain, wind, sand, or other factors such as falling with or dropping my equipment. These risks and dangers may also be caused by my own actions, or inactions, the actions or inactions of others participating in the workshop. There may be other risks and social and economic losses either not known to me or not readily foreseeable at this time. I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the workshop or private instruction.

I do assume all the above risks and will hold the Releasees harmless from any all liability, actions, causes of action, claims, debts and demands which may arise in connection with my photo workshop or private instruction. I agree not to sue the Releasees, independent contractors, volunteers or employees, any sponsors, advertisers and, if applicable, owners and lessors of premises, on which the workshop or instruction may take place. The terms of this document serve as a release from all liability, claims, demands, losses, damages or demands. I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save and hold harmless each of the Releasees from any litigation’s expenses, attorney fees, liability, damage or cost which may occur as a result of any such claim. This waiver shall serve as a release and assumption of risk for my heirs, administrators and executors, and for all members of my family, including any minors accompanying me.

I have read this agreement, fully understand its terms and understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, not withstanding, shall continue in full force and effect.
